These Terms of Use (“Terms”) govern the use of:
- the MIP Classicyoga mobile application;
- the website classicyoga.com;
- the website online.sivananda.co.il; and
- any related pages, services, digital products, learning areas, membership systems, communications, and platforms operated by Sivananda Yoga Vedanta Center Association (R.A.), Registration No. 580021483
(collectively, the “Platform”).
By accessing or using the Platform, you confirm that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, please do not use the Platform.
1. About the Platform
Sivananda is a yoga school specializing in yoga, meditation, personal development, nutrition, and a healthy lifestyle.
The Platform may include:
- online courses, classes, workshops, recordings, meditations, and study materials;
- in-person or online events, sessions, classes, workshops, and retreats;
- memberships and subscription-based access;
- student areas and LearnDash-based course environments;
- product, service, and program information; and
- communication tools and contact options.
2. Eligibility
You may use the Platform only if you are legally capable of entering into binding legal terms under applicable law.
If you create an account or purchase a membership on behalf of another person, you represent that you are authorized to do so.
3. Permitted Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms.
You must not:
- use the Platform in any unlawful, abusive, fraudulent, deceptive, or harmful manner;
- interfere with, damage, disrupt, overload, or compromise the Platform or its functionality;
- attempt to gain unauthorized access to accounts, content, systems, or data;
- copy, reproduce, distribute, publish, display, modify, sell, sublicense, or exploit Platform content except as expressly permitted;
- share restricted member-only or purchased content with others without authorization;
- upload malicious code, spam, or harmful material;
- impersonate another person or misrepresent your identity; or
- use the Platform in a manner that infringes the rights of Sivananda or any third party.
4. Memberships, Accounts, and Login Access
Certain parts of the Platform may require account registration, login credentials, or an active membership.
You are responsible for:
- providing accurate and current registration information;
- maintaining the confidentiality of your login credentials;
- all activity carried out under your account; and
- notifying us promptly of any unauthorized access or suspected misuse of your account.
We reserve the right to suspend, restrict, or terminate access to any account or membership if we reasonably believe that misuse, unauthorized sharing, breach of these Terms, or unlawful activity has occurred.
5. LearnDash and Course Access
The Platform may use LearnDash or similar learning systems to provide course access, student tracking, lesson progression, and digital learning functions.
Access to courses, lessons, recordings, or membership content may be limited according to the plan, membership, purchase, access period, or enrollment status applicable to your account.
We reserve the right to modify course structure, lesson order, instructor assignments, content availability, release schedules, and learning features at any time.
6. Purchases, Memberships, and Payments
The Platform may allow you to purchase digital content, join memberships, register for services, or reserve participation in classes, workshops, events, or other offerings.
Payments may be processed through WooCommerce and related payment service providers or gateways.
All purchases, registrations, and memberships are subject to availability, confirmation, and any additional specific terms that may apply to the relevant offer.
We reserve the right to:
- refuse or cancel an order, registration, membership, or booking;
- correct pricing, typographical, technical, or descriptive errors;
- modify fees, schedules, content, availability, or program structure; and
- discontinue any product, service, feature, or offering at any time.
Unless otherwise expressly stated in a specific refund or cancellation policy, payments are non-refundable except as required by applicable law.
7. Digital Content License
All digital content made available through the Platform, including videos, audio recordings, texts, PDFs, meditations, course materials, and live or recorded classes, is provided for your personal, non-commercial use only unless expressly stated otherwise in writing.
You may not copy, record, reproduce, distribute, share, upload, publish, broadcast, sell, sublicense, modify, or otherwise exploit any Platform content without prior written permission.
8. Intellectual Property
All rights, title, and interest in and to the Platform and all content available through it, including text, branding, graphics, designs, logos, course materials, videos, audios, downloads, software, layout, and functionality, are owned by or licensed to Sivananda unless otherwise stated.
Nothing in these Terms grants you any ownership right or any license beyond the limited right to use the Platform for its intended personal and lawful purpose.
9. User Content
If you submit, upload, post, or otherwise provide any content through the Platform, including comments, testimonials, feedback, messages, recordings, or community submissions (“User Content”), you represent that:
- you have the legal right to provide such content;
- the content does not infringe the rights of any third party; and
- the content is not unlawful, abusive, defamatory, obscene, misleading, or harmful.
You grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, display, adapt, and publish such User Content for purposes connected with operating, improving, promoting, or providing the Platform, subject to applicable law.
We may remove User Content at our discretion.
10. WhatsApp and Communications
The Platform may include a WhatsApp contact button, email contact options, newsletters, and other communication channels.
Your use of WhatsApp or similar third-party tools may be governed by the terms and privacy practices of those third parties.
We are not responsible for the operation, availability, or data handling practices of third-party communication platforms.
11. Health and Well-Being Disclaimer
The Platform may include information and practices relating to yoga, meditation, breathing, movement, nutrition, lifestyle, personal development, and well-being.
All such content is provided for general educational and informational purposes only. It is not medical advice, mental health advice, diagnosis, or treatment, and it is not a substitute for advice from a qualified physician or other licensed healthcare professional.
Participation in yoga, meditation, breathing exercises, movement practices, or related activities involves personal responsibility and may involve physical, emotional, or other risks. You are solely responsible for determining whether participation is appropriate for you.
By using the Platform and participating in any class, course, session, workshop, retreat, or practice, you acknowledge and accept these risks.
12. No Guarantee of Results
We do not guarantee any specific physical, emotional, spiritual, educational, personal, or commercial result from use of the Platform or participation in any service, course, membership, or offering.
Any testimonials or examples presented on the Platform are illustrative only and do not constitute a promise or guarantee.
13. Availability of the Platform
We do not guarantee that the Platform will be available at all times or without interruption, delay, error, incompatibility, or security issues.
We may modify, suspend, restrict, or discontinue all or any part of the Platform at any time, with or without notice.
14. Third-Party Services and Links
The Platform may contain or rely on third-party tools, services, plugins, gateways, websites, apps, embedded media, payment systems, analytics services, communication tools, and social media integrations.
We do not control and are not responsible for the content, privacy practices, availability, or legal terms of such third parties. Your use of third-party services is at your own risk.
15. Privacy
Our collection and use of personal information in connection with the Platform is governed by our Privacy Policy, as updated from time to time.
16. Limitation of Liability
To the fullest extent permitted by law, Sivananda, the School, and their officers, employees, teachers, representatives, affiliates, contractors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or other damages arising out of or related to:
- your use of or inability to use the Platform;
- reliance on any content or information provided through the Platform;
- participation in any class, course, session, retreat, event, or practice;
- interruptions, delays, data loss, errors, bugs, or technical failures;
- unauthorized access to accounts or information; or
- acts or omissions of third parties.
If liability is imposed despite the foregoing, such liability shall be limited to the amount actually paid by you to us for the specific service or content giving rise to the claim, if any.
17. Indemnification
You agree to indemnify and hold harmless Sivananda, the School, and their officers, employees, teachers, representatives, affiliates, contractors, and service providers from and against any claim, demand, liability, loss, damage, cost, or expense, including reasonable legal fees, arising out of or related to:
- your use of the Platform;
- your breach of these Terms;
- your violation of applicable law; or
- your infringement of any rights of a third party.
18. Suspension and Termination
We may suspend, restrict, or terminate your access to the Platform, without prior notice, if we believe that:
- you breached these Terms;
- you engaged in misuse or unauthorized sharing of access;
- you acted unlawfully, abusively, or fraudulently;
- you endangered the Platform, staff, teachers, users, or third parties; or
- such action is necessary to protect our legitimate interests.
Termination shall not affect any rights or obligations accrued before termination.
19. Changes to the Terms
We may update these Terms from time to time. Any updated version shall become effective upon publication on the App, the relevant website, or through other appropriate notice, unless otherwise required by law.
Your continued use of the Platform after publication of updated Terms constitutes acceptance of the updated Terms.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Platform shall be subject to the competent courts in Tel Aviv, Israel, unless mandatory applicable law requires otherwise.
